1. Acceptance of Terms

By using our pickleball court facilities or accessing our website, you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these terms, you may not use our services.

2. Booking and Cancellation Policy

  • Reservations: Courts must be booked in advance through our website or other designated booking methods.
  • Payment: Full payment is required at the time of booking.
  • Cancellation: All cancellations made are non-refundable.
  • No-shows: Bookings will be forfeited after 15 minutes if the user does not show up, with no refund provided.

* Pickle Sky reserves the right to refuse entry if you disobey and infringe the rules set herein.

3. Code of Conduct

  • All players must wear appropriate attire, including non-marking court shoes.
  • Offensive language, aggressive behavior, or damage to the facilities is strictly prohibited.
  • Respect for other players, staff, and property is required at all times.

4. Liability Waiver

  • Players and visitors use the facilities at their own risk.
  • The facility is not responsible for injuries, loss, or damage to personal belongings.
  • All users must sign a waiver before using the courts.

5. Exclusion of Occupiers’ Liability

To the fullest extent permitted by law, the owners and operators of the pickleball court facilities (the “Occupiers”) disclaim any and all liability for injuries, damages, or losses sustained by users, spectators, or other visitors while on the premises, including but not limited to:

  1. Negligence of the Occupiers: Any injuries or damages resulting from the ordinary negligence of the Occupiers or their employees.
  2. Actions of Third Parties: Accidents or injuries caused by other users, spectators, or unauthorized individuals.
  3. Unforeseen Hazards: Damage or injuries caused by natural hazards, such as slippery surfaces, weather conditions, or other unforeseeable events.
  4. Equipment Use: Improper or unauthorized use of equipment provided on-site.

User Responsibility:

  • Users are responsible for assessing their own fitness, health, and capability to participate in activities on the court.
  • Users are required to exercise caution and follow all posted safety instructions.
  • The Occupiers are not responsible for any injuries or damages caused by failure to adhere to these guidelines.

Indemnity Clause:

By using the facilities, users agree to indemnify and hold harmless the Occupiers from any claims, demands, or lawsuits arising out of their use of the premises or any breach of these terms.

6. Facility Rules

  • Courts are for pickleball use only unless prior approval is obtained.
  • Equipment must be returned after use in the same condition it was provided.
  • Food and beverages (except water) are not allowed on the court.
  • Smoking and alcohol consumption are prohibited on the premises.

7. Membership

  • Memberships, if applicable, are non-transferable and must be used by the individual named on the account.

8. Use of Website

  • Users must ensure that the information provided during booking is accurate and up-to-date.
  • Misuse of the website, including unauthorized access or fraudulent bookings, may result in suspension of services.

9. Privacy Policy

We respect your privacy and will only use your personal information as outlined in our Privacy Policy. By using our website, you consent to the collection and use of your information.

10. Amendments to Terms

We reserve the right to update or modify these Terms and Conditions at any time without prior notice. Continued use of our services constitutes acceptance of the updated terms.

11. Governing Law

These terms and conditions are governed by the laws of Malaysia, and any disputes will be resolved exclusively in the law of Malaysia.
